These Terms and Conditions ("Agreement") govern the installation and configuration of equipment by Altek Industries LLC for the customer COMPANY NAME. By engaging the Company's services for equipment installation and configuration, the Customer agrees to be bound by the terms and conditions outlined herein. It is important to carefully read and understand this Agreement before proceeding with any installation or configuration work.
Scope of Work: 1.1 The Company will provide equipment installation and configuration services as specified in the agreed-upon project scope, work plan, or statement of work. 1.2 The specific equipment to be installed and configured will be identified and mutually agreed upon between the Company and the Customer. 1.3 In the case that additional work arises outside the current agreed-upon Scope of Work, such work will be billed at a rate of $75.00 per hour, subject to client approval.
Customer's Responsibilities: 2.1 The Customer acknowledges and agrees to provide full cooperation, assistance, and access to necessary resources required for the installation and configuration process. 2.2 The Customer is responsible for ensuring that all necessary equipment, including hardware, software, licenses, and any other components, are available and ready for installation. 2.3 The Customer shall provide accurate and complete information related to the equipment and its intended use to enable effective installation and configuration. 2.4 The Customer is responsible for ensuring that all required prerequisites, such as network connectivity, power supply, and physical installation environment, are in place prior to the Company's arrival for installation.
Installation and Configuration: 3.1 The Company will use reasonable skill and care to perform the equipment installation and configuration services according to industry standards and best practices. 3.2 The Company shall not be responsible for any issues arising from pre-existing conditions, limitations, or incompatibilities of the Customer's infrastructure, network, or systems, unless explicitly stated otherwise in the agreed-upon project scope. 3.3 Any changes or modifications to the agreed-upon project scope may require additional time, effort, or resources and shall be subject to separate negotiation and agreement between the Company and the Customer.
Acceptance and Testing: 4.1 Upon completion of the installation and configuration, the Customer shall have the opportunity to test and verify the functionality of the installed equipment. 4.2 The Customer must promptly notify the Company of any issues, errors, or discrepancies discovered during the acceptance testing period. 4.3 Acceptance of the installed and configured equipment by the Customer, or its authorized representative, shall indicate satisfactory completion of the Company's services.
Warranty and Support: 5.1 The Company warrants that the installation and configuration services will be performed with reasonable skill and care. 5.2 Warranty and support for the installed equipment may be subject to separate terms and conditions provided by the equipment manufacturer or vendor. The Customer shall refer to such terms and conditions for specific warranty and support details.
Liability: 6.1 The Company shall not be liable for any damages, losses, or liabilities arising from the installation, configuration, or use of the equipment, whether directly or indirectly, unless caused by the Company's gross negligence or willful misconduct. 6.2 The Customer assumes all risks associated with the use of the installed equipment and shall be solely responsible for any consequences, including but not limited to data loss, network interruptions, or system malfunctions.
Confidentiality: 7.1 The Company and its personnel shall maintain the confidentiality of any proprietary, sensitive, or confidential information disclosed by the Customer during the installation and configuration process, subject to applicable laws and regulations.
Modifications and Amendments: 8.1 Any modifications or amendments to this Agreement must be made in writing and mutually agreed upon by both parties. 8.2 No oral representations or statements.
Equipment and Parts: 9.1 The Customer is solely responsible for providing payment upfront for the purchasing all necessary equipment, parts, and components as agreed upon for the installation and configuration. 9.2 The Company shall be responsible for the acquisition, delivery, or warranty of the equipment and parts. 9.3 The Customer agrees to bear all costs associated with the purchase, including but not limited to the price of the equipment, shipping charges, taxes, customs duties, and any other applicable fees.
Payment Terms: 10.1 Payment for equipment is to be remitted in advance prior to the commencement of any on-site work. 10.2 Additionally, one hundred percent (100%) of the labor charges are to be settled prior to the start of the project. No installation or configuration work will begin until full payment has been received.
Cancellation Policy: 11.1 Upon signing this Agreement and making the initial payment, the Customer has a seven-day window to cancel the project and request a full refund. 11.2 If the cancellation request is made within this seven-day period, the Customer will receive a full refund of the payment made, including any hardware charges. 11.3 After the seven-day grace period has expired, any cancellations will be subject to a non-refundable charge of twenty percent (20%) of the total labor cost. 11.4 The hardware charges will still be refundable in full.
By engaging the Company's services for equipment installation and configuration, the Customer acknowledges that they have read, understood, and agreed to be bound by the terms and conditions set forth in this Agreement.
